Atlantic Container Service – Terms and Conditions
1. Introduction & Acceptance of Terms
Welcome to Atlantic Container Service. This website, located at atlanticcontainersservice.com (the “Site”), is owned and operated by Atlantic Container Service. Throughout the Site, the terms “we,” “us,” and “our” refer to Atlantic Container Service.
By accessing our Site, browsing our inventory, requesting quotes, or purchasing heavy-duty containers, site office cabins, modular units, or welfare blocks from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms and Conditions”, “Terms”), including those additional terms, conditions, and policies referenced herein or available by hyperlink. These Terms apply to all users of the Site, including without limitation commercial buyers, site managers, procurement officers, and corporate clients.
Please read these Terms carefully before accessing or using our website. If you do not agree to all the terms and conditions of this agreement, you may not access the website or use any of our services.
2. Eligibility & Commercial Capacity
By agreeing to these Terms and Conditions, you represent that you are at least the age of majority in your state or province of residence. As our product inventory consists of high-ticket, industrial heavy equipment, you represent and warrant that you possess the legal authority and commercial capacity to bind your business entity to financial transactions, heavy freight logistics responsibilities, and site safety compliance requirements.
3. Product Presentation, Specifications, & Modifications
We make every effort to display the dimensions, structural configurations, interior features, and colors of our containers and modular cabins as accurately as possible on our Site. However:
Technical specifications, weights, and interior modifications are approximations and may vary slightly based on manufacturing cycles.
Prices for our products and customization services are subject to change without notice.
We reserve the right at any time to modify or discontinue a specific product line, unit layout, or structural configuration without liability to any customer or third party.
4. Order Acceptance, Quotes, & Billing Info
The presentation of industrial units on our website does not constitute a legally binding offer, but rather an invitation to request a formal corporate quote.
Quote Verification: A contract is only finalized once our team reviews your specific site logistics, issues a formal invoice/quote, and receives verified clearance of funds.
Order Refusal: We reserve the right to refuse, limit, or cancel any order or quote request you place with us. This includes restrictions placed under the same corporate account, the same credit card, or orders that utilize identical billing and shipping addresses.
Accuracy of Information: You agree to provide current, complete, and accurate purchase, billing, and contact information for all transactions conducted via our sales department. You agree to promptly update your account and other information, including your email address and payment details, so that we can complete your transactions and contact you as needed.
5. Payments, Taxes, & Financial Processing
All financial transactions are calculated and executed in US Dollars ($).
Payment Terms: Payment must be cleared in full before any standard unit dispatch or custom engineering preparation begins, unless formal corporate credit terms have been explicitly authorized in writing by our corporate compliance officer.
Taxes and Tariffs: Buyers are fully responsible for all applicable state, local, or federal sales taxes, commercial usage tariffs, or corporate site levies applicable to the final delivery destination.
6. Shipping, Logistics, & Risk of Loss
All parameters regarding handling speeds, transit times, order cut-off constraints, and mandatory site access conditions are strictly governed by our standalone Shipping & Delivery Policy.
The risk of loss, damage, structural deterioration, or environmental liability transfers entirely to the buyer immediately upon the driver executing the hydraulic crane (Hiab) drop-off and the buyer’s authorized site representative signing the official Delivery Acceptance Receipt.
7. Prohibited Uses of the Site
In addition to other prohibitions as set forth in these Terms, you are prohibited from using the Site or its content:
For any unlawful commercial or industrial purpose.
To solicit others to perform or participate in any unlawful acts.
To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances.
To infringe upon or violate our intellectual property rights or the intellectual property rights of others.
To upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet.
8. Limitation of Liability & Indemnification
Atlantic Container Service, our directors, officers, employees, affiliates, or field operators shall not be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind.
This includes, without limitation, lost profits, lost revenue, lost site operational hours, structural delays, structural failures, or property damage resulting directly or indirectly from site delivery vehicle routing, failed ground preparation, improper crane stabilization, or the use/misuse of any structural units purchased from us.
You agree to indemnify, defend, and hold harmless Atlantic Container Service from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or site safety regulation.
9. Governing Law
These Terms and Conditions and any separate corporate agreements whereby we provide you product fulfillment or structural customization services shall be governed by and construed in accordance with the laws of the State of Georgia, USA, without regard to conflict of law principles. Any legal actions or formal disputes arising under this agreement must be filed exclusively in the courts located in Savannah, Georgia.

You can review the most current version of the Terms and Conditions at any time on this page.
